there was a rework on the vehicles for poor starting that the engine ecu requires updating so a egr self cleaning programme is added if this doesnt work, the egr needs replacing under warranty"

Make sure they have updated the ECU software with the latest available. They don't sound like a very competent dealership (where was it?). We had a lot of problems with EGR valves sticking on these and it's a big job to replace. The software updates cured a lot of them.
